The following terms apply to the rental of golf carts through EAGL Technologies AS' websites eagl.app and the EAGL app ("EAGL").
EAGL is operated by EAGL Technologies AS (Org. no. 923 569 839 MVA), postal address Hoffsveien 15, 2075 Oslo.
1. Registration
1.1 When registering as a renter of golf carts, you must declare the number of golf carts the club, or you as owner, has. By using EAGL's services (hereinafter referred to as the Service), you may rent out golf carts you own or, by presenting a power of attorney to EAGL, third-party carts.
1.2 The golf carts must at all times satisfy EAGL's requirements for safety and suitability. EAGL may freely change and/or update the requirements for rental, and you are obliged to follow the requirements set by EAGL.
2. The Rental Agreement
2.1 When the renter confirms and the operator accepts a reservation, a binding rental agreement is entered into between the renter and the operator. The rental location and time period are defined by the operator and the renter through the EAGL Service. In addition to the rental agreement, the following are considered part of the terms: the rental price defined locally by the golf club and through the EAGL Service, these operator terms, and EAGL's requirements for operators.
3. Availability
3.1 The operator sets the price locally through the Service. The operator is obliged to make the golf carts available to the renter. The Service charges a fee to allow you to use the service in connection with rentals. The golf cart must be charged and capable of completing at least 9 holes for the rental to be carried out.
3.2 EAGL uses third-party mobile networks to ensure connectivity between the app and the IoT component. This also applies during periods of low or high mobile network load. Availability and response time may therefore vary and are outside EAGL's control.
4. Rental Fee
4.1 The operator is obliged to make the golf cart available at the agreed time. If several golf carts are available and not pre-booked when the renter arrives at the location, a cart shall be made available for rental.
4.2 EAGL charges a fee to allow you, as the operator, to use the Services for golf cart rental and fleet management. An updated fee schedule will be included in the signed agreement, and EAGL reserves the right to invoice retroactively for use of the service equal to the percentage agreed in the agreement plus NOK 10 per rental.
5. Payout of Rental Income
5.1 The local price set by the operator is collected by the Service on behalf of the operator. The Service pays the amount to the operator, less fees, on the 25th of the following month via Stripe.
5.2 The operator may not charge consideration from the renter in connection with the rental agreement, with the following exception:
- When the renter does not use the Service, the operator shall assist in carrying out the rental.
5.3 The Service reserves the right to offset any claims the Service has against the operator.
5.4 Please note that the operator is fully responsible for all fees and expenses in connection with renting out a golf cart through the Service, unless otherwise specified in separate agreements.
5.5 By law, the Service is required to report rental income transferred to you as the operator. To fulfil this obligation, the Service depends on receiving certain information about the operator. The Service reserves the right to withhold rental income until we have received the necessary information.
5.6 Before payout of rental income, associated transaction costs related to the golf club are deducted.

6. Maintenance
6.1 The golf cart must at all times be in safe, drivable condition and in good mechanical state. The golf cart must be configured, equipped and/or built and maintained so that it cannot cause danger or inconvenience to the driver or others. The operator is at all times responsible for ensuring that the golf cart meets the manufacturer's technical requirements and applicable laws and regulations. If deviations are found, the operator shall take corrective measures as soon as possible. EAGL reserves the right to list golf carts and/or remove them from listings if a cart does not meet the requirements set out in this section.
7. Equipment
7.1 Equipment such as the EAGL IoT component may be either purchased, leased, or loaned from EAGL. The operator is responsible for ensuring that equipment is used as agreed and for no other purpose, and only with EAGL's services and systems unless otherwise agreed. Leased or loaned equipment shall be returned in good condition. Upon return of equipment with wear beyond normal use, EAGL may claim reimbursement. If equipment is not returned, EAGL may invoice the customer for time spent and for the missing equipment. Repair of the IoT component must only be performed by EAGL. The customer bears the risk of shipping and transport related to repair or replacement.
7.2 The customer shall not modify the IoT component or install it in any way other than as described in the manuals and instructions. The customer shall notify EAGL of any possible damage to the IoT component as soon as possible.
7.3 To ensure quality through the service, EAGL may at any time make changes and upgrades regardless of whether the equipment is purchased, leased, or loaned from EAGL. The same applies to changes in the renter's and operator's user interface.
7.4 You shall not open, allow others to open, or examine the contents of the IoT component under any circumstances. In the event of breach of this section, EAGL may pursue legal action and claim compensation for any resulting damages.
8. Damages
8.1 The golf cart must be inspected by the operator after every rental. If damages are discovered that you believe were caused by the renter, this must be documented and reported to EAGL at incident@eagl.app immediately upon becoming aware of the damage, and no later than 48 hours after the cart is returned. When submitting an incident, you will receive a damage report form to fill out. You are obliged to cooperate with EAGL, insurance companies, and their representatives in the investigation of the incident. If you fail to report damages as described, or fail to cooperate in the investigation, EAGL and the insurance company may reject any claim for payouts related to the incident.
8.2 EAGL may share information when handling damages, including personal data related to your insurance settlement, with the renter in order to collect deductibles.
9. Disclaimer of Liability
9.1 EAGL is a service provider that helps golf clubs and golfers connect in a simple and efficient way. EAGL's optimisation of golf cart rental is a service and platform for entering into agreements between the golf club's golf carts and renters, as well as handling rental payments. EAGL shall under no circumstances be considered a party to any agreement for the rental of a golf cart.
9.2 EAGL expressly disclaims any liability for the rental agreement. This includes, but is not limited to, losses resulting from the cart not being returned at the agreed place or time, as well as other inactivity by the renter.
10. Termination
10.1 The agreement shall be terminated with 6 months' notice from the current month. After expiry of the agreement in accordance with the binding period stated in the agreement, the agreement is renewed for up to 3 years unless otherwise arranged.
10.2 If the agreement is terminated before its expiry, EAGL may claim compensation for the remaining time and expected revenues based on history and rental patterns.
11. Reservations
11.1 EAGL reserves the right with respect to technical obstacles, such as telecommunications provided by third parties, which may prevent the service from being delivered as desired.
12. Governing Law
12.1 The terms are governed by and shall be interpreted in accordance with Norwegian law and jurisdiction.
13. Changes
13.1 EAGL may make changes to optimise the service, such as changes to dashboards, control systems, or services that are removed or replaced with another solution.
